Terms and Return Policy

DAMAGE/RETURN/CANCELLATION POLICY:

Please verify styles, colors, quantities, gate sizes and height before placing your order. Custom-fabricated material is non-refundable. This includes but is not limited to arched gates, custom posts, special orders and disassembled panels. Customers wishing to cancel an order need to do so within 24 hours to avoid cancellation charges from the factory. Customer is responsible for verifying final quantities. Fences4Less.Com offers design services as a free service to our customers, but we cannot be held responsible for errors or omissions. All deliveries of Jerith material are to commercial sites only. Commercial sites are open from 8-5, M-F, unless noted and do not receive a phone call prior to delivery. If a phone call is required there is a $25.00 fee. Commercial customers are responsible for making arrangements for delivery if their facility is not open during standard business hours. Unless otherwise noted all shipments follow FTC Rule 435. If a shipment is time sensitive Fences 4 Less must be notified at the time at the time the order is placed – please call Fences 4 Less for a quote on time critical shipment fees.

Jerith customers have the option of paying $175.00 at time of order for a residential delivery. Jerith customers may waive this fee and elect to have the material picked up at the shippers local terminal, or arrange for residential delivery directly with the carriers at time of delivery ($175.00 fee is not guaranteed at this time). If customer requests a lift gate, incurs additional overtime, incurs a re-delivery fee, or uses other optional service from shipper, customer must contract these services directly with shipper and pay driver at time of delivery. Customer agrees that they are responsible for any additional fees charged by freight company. If Fences4less.com is backbilled for any additional fees, the customer will be billed for these charges. In compliance with DOT guidelines, shipper only guarantees product to be free from damage when the truck drives onto the customers property.

Customers are responsible for unloading the truck and assume full liability for damage to material while unloading – even if driver assists. Customer understands that each trucking company provides insurance for damaged or shorted material while in transit, once the packing slip is signed, customer accepts the order “AS IS” and waives his/her right to process a freight claim – signer must be 18 or older. If driver refuses to stay while the material is being inventoried, sign the packing slip and state “Driver un-willing to stay while inventorying truck and checking for damaged material”. Problems are rare, but if they do occur, sign and mark the problem on the shipper and inform Fences4Less.Com immediately of the problem. An insurance adjuster will be assigned in your area and you will be notified of the steps being taken. Returned or refused deliveries incur up to a 50% re-stocking fees plus applicable cancellation fees, in-bound freight charges, and shipping and handling back to manufacturer at higher rates. DO NOT REFUSE DELIVERY. Tipping of LTL drivers is customary, but not required. Cancellation of orders not shipped may be subject to cancellation fees. NMFC rules for Uniform Bill of Lading terms and conditions provide insurance from pick up at our facility to delivery to consignee. If customer vacates the material and/orrefuses to accept shipment, consignee assumes full liability as mandated by DOT regulations and the NMFC.

Temporary fence panels are for use around construction sites. Damage claims are limited to form, fit and function; aesthetics are not covered.

If your order does not qualify for free freight we will send you a quotation. Unless otherwise specified all sales are FOB Fences4Less distribution points. Free freight when offered only applies to orders shipped within the 48 contiguous states. We will not process the order until you have authorized any applicable freight charges. Call for exact pricing.

Container Customers:  If your order is door-to-door delivery, or a re-consigned delivery of a container, then a non-refundable $4,000.00 deposit will be required. In the event there is a default on the account, this money will be used to freight forward your material to another customer or to our yard. When the container is within one week of arriving at the port, the balance of the money must be paid unless there are terms in place with Fences4Less,Inc. It is extremely important that payment is received promptly so the overseas factory will have time to Tel-Ex release the container.  If payment is not timely, Fences4Less.Com will use an outside factoring company to finance the container at 10% of the outstanding balance for up to 30 days at customers expense – subject to financial approval.  If the container is discharged from the port and credit nor payment are available at time of discharge, then the container and the customers deposit will be forfeited. Customer will remain responsible for any additional fees associated with the re-direct of this container. Once the container is delivered, customers will have two hours to unload the container. If there is standing time on the container, then the customer will be invoiced for that time.  Make sure you mark the start time and end time on the shipper.

Customers receiving any type of truck delivery understand that they are responsible to pay for delays or standing time to unload.

The parties agree to the exclusive jurisdiction of the federal and state courts located in San Diego County, California, in any action arising out of or relating to this sale/agreement. The parties waive any other venue to which either party might be entitled by domicile or otherwise.
